EPC contracts and Electricity contracts (PPA) in LATAM during COVID-19

The event will discuss the impacts of COVID-19 in different aspects of the supply chain in the construction industry. We will discuss construction impacts such as labor shortage, social distancing among others and how damage calculation methods have been affected by COVID-19. The event will discuss the types of PPAs used in LATAM region, how they work, how they have performed and what kinds of disputes have arisen among stakeholders as a result COVID. PPP’s are an essential tool for the collaboration of a government agency and a private sector company to finance large-scale infrastructure related projects. This tool is of importance for Latin American countries to promote economic development by expanding their current local infrastructure which has been greatly affected due to the COVID-19 pandemic.

Loss of productivity methodologies also will be discussed.

The event will discuss the types of PPAs used in LATAM region, how they work, how they have performed and what kinds of disputes have arisen among stakeholders as a result COVID. PPP’s are an essential tool for the collaboration of a government agency and a private sector company to finance large-scale infrastructure related projects. This tool is of particular importance for Latin American countries to promote economic development by expanding their current local infrastructure which has been greatly affected due to the COVID-19 pandemic. The economic and fiscal challenges presented by this crisis has intensified many LATAM government’s interest in implementing new PPP legislation and making use of a new legal framework. We conclude that standard PPA clauses are not always sufficient to deal with supply and demand disruptions such as the ones seen during the COVID pandemic.

Speaker information (for public page) Andrés Chambouleyron has a unique blend of experience in both private and public sectors. He is an industrial engineer with a Ph.D. in Economics and has more than 20 years of experience in teaching, consulting and as an economic expert in international and commercial arbitration cases providing testimony in the US, Canada, Europe and Latin America on sectors like electricity, oil & gas, telecoms, manufacturing and water and sanitation. Andrés has also extensive experience as a public officer in the energy sector: First as Argentina’s Under Secretary of Energy and Mining in charge of both electricity and natural gas wholesale pricing regulation and more recently as Chairman of the Board of Argentina’s Federal Electricity Regulator (ENRE) in charge of electricity distribution and transmission rate and quality of service regulation.

Andres Alva, P.E., PSP, is a Managing Director with BRG, and has over 20 years of experience in the construction industry. He is bilingual in Spanish and English. Mr. Alva has worked with owners, contractors, construction managers, program managers, and other professionals on major construction projects in the United States and South America. He specializes in analyzing construction claims involving excessive changes, interference, and schedule delays. His work involves analyzing schedules and labor productivity, assessing entitlement to damages, and quantifying damages using the measured mile.
Mr. Alva analyzes and quantifies schedule delays, disruptions, and acceleration issues and performs various types of schedule analysis, including as‐planned vs. as‐built, time impact analysis, and windows schedule delay analysis. He also quantifies damages associated with productivity, construction defects, changes in work, and other loss issues. Mr. Alva has provided written and oral testimony or expert advice in several cases before the ICSID, ICC, and multiple chambers of commerce. He has written numerous expert reports for delay and quantum, analyzing and reviewing disruption, damages claims from $ 1 million to more than 800 million.

Dr Herfried Wöss is international arbitrator and partner of Wöss & Partners Arbitration - Damages - Trade - Infrastructure - Energy (Mexico City - Washington DC - Lima - Vienna* ) and has extensive experience in international commercial and investment arbitration under the ICC, UNCITRAL, ICSID, NAFTA and various local arbitration rules both as arbitrator and party counsel. His arbitration experience spans from refinery-ships, thermo-electrical plants and substations, gas and oil pipelines, EPC turnkey projects, public-private partnerships, M&A, joint venture agreements, franchise agreements, international sales contracts, and the telecommunications, automotive and pharmaceutical industries. Several of his awards and publications have produced judicial precedents in favour of arbitration.

As part of his corporate practice, he has advised clients and financial institutions in international public tenders and contracts with state entities as regards infrastructure and construction projects, privately-financed infrastructure projects, hydro and thermoelectric power plants, transmission lines, wind and solar energy projects.

Dr Herfried Wöss is author of the Oxford University Press monograph "Damages in International Arbitration under Complex Long-term Contracts" (2014) together with his partner Adriana San Román Rivera and two prominent economists.

Dr Wöss is also considered one of the leading international trade lawyers and has participated in cases before the European Court of Justice, the WTO, anti-dumping and countervailing duty investigations and other trade measures in different countries around the world, particularly in Latin America. Dr Wöss has been visiting scholar for arbitration at the Georgetown University Law Center in Washington DC from 2012-2013. He works in German, English and Spanish and reads French. (*rep. office)
